Starting today, a new law takes effect in New York State. The law is S.8420-A. Governor Kathy Hochul signed it in December 2025.
The rule is straightforward. If an advertisement uses an AI-generated virtual person, it must clearly disclose that "this person was created by AI." If a YouTube ad uses an AI-generated face instead of a real actor, viewers must be able to recognize that immediately.
What happens if a company does not comply? The penalty is $1,000 for a first violation and $5,000 for each later violation.
There are exceptions. Ads for films, television, or games may show the same AI character used in the underlying work itself. Audio-only ads are also outside the rule.
This is the first state-level law of its kind to take effect in the United States. Advertising producers, YouTube creators, and marketing agencies should check right now whether ads exposed in New York State are missing AI disclosures.
